Welcome to Munchify (“the Platform,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Munchify mobile application, website, and all related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree, you may not use Munchify.
“Customer” – any individual or entity ordering food, goods, or services through Munchify.
“Vendor” – any business or kitchen registered on Munchify to sell food, products, or other goods.
“Rider” / “Delivery Partner” – any individual authorized to deliver orders made through the Platform.
“Order” – a confirmed request placed by a Customer through Munchify.
“Account” – the unique profile created to access Munchify Services.
“Content” – all text, graphics, images, audio, software, and data appearing on Munchify.
By creating an Account or using Munchify, you acknowledge that:
You have read, understood, and agreed to these Terms.
You are at least 18 years old or have legal capacity to enter into this agreement.
You consent to receive communications (via email, SMS, or app notifications) related to your use of the Platform.
You agree to use Munchify solely for lawful purposes. You shall not:
Use the Platform to commit fraud, abuse, or any form of illegal activity.
Interfere with or disrupt Munchify servers, networks, or data.
Use automated tools (bots, scrapers, etc.) to extract or manipulate data.
Misrepresent your identity or affiliation.
Munchify reserves the right to suspend or terminate Accounts that violate these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account.
If you suspect unauthorized access, notify us immediately at support@munchify.store.
Munchify shall not be liable for any loss or damage arising from unauthorized use of your Account.
All Orders placed through the Platform constitute an offer to purchase the listed items.
Acceptance of an Order occurs when the Vendor or Munchify confirms it.
Prices displayed are inclusive of applicable taxes unless otherwise stated.
Payments can be made through approved digital methods (wallet, card, mobile money, or cash on delivery).
Munchify reserves the right to:
Refuse or cancel Orders for any reason (fraud detection, unavailability, or system error).
Adjust prices, charges, and discounts at any time without prior notice.
Delivery times are estimates and may vary due to location, demand, or external factors (traffic, weather, etc.).
Ownership and risk in the items transfer to the Customer upon delivery confirmation.
If a delivery attempt fails due to inaccurate address or unavailability of the Customer, Munchify may charge additional fees or cancel the Order.
Orders can only be canceled before confirmation by the Vendor.
Once preparation or dispatch begins, cancellations are no longer possible.
Refunds, if applicable, will be processed through the original payment method.
Perishable items (e.g., food, groceries) are non-returnable unless defective or incorrect.
Munchify’s decision on refunds shall be final.
Vendors and Riders operate as independent contractors, not employees or agents of Munchify.
Munchify is an intermediary providing digital access and logistics facilitation. It does not own, prepare, or directly sell any items unless explicitly stated.
Munchify shall not be responsible for:
The quality, safety, or legality of items sold by Vendors.
Delays, damage, or loss arising from third-party delivery.
All intellectual property on Munchify, including trademarks, software, designs, and content, belongs to Munchify Technologies or its licensors.
You may not reproduce, distribute, modify, or exploit any part of the Platform without prior written consent.
Munchify collects and processes personal information in accordance with its Privacy Policy.
By using our Services, you consent to such collection and processing.
To the fullest extent permitted by law, Munchify shall not be liable for:
Any indirect, incidental, or consequential damages arising from your use of the Platform.
Delays, delivery failures, or performance issues caused by third parties.
Errors or inaccuracies in Vendor information or menu listings.
Total liability, if any, shall not exceed the total amount paid for the specific Order in dispute.
You agree to indemnify and hold harmless Munchify, its affiliates, officers, employees, and partners from any claims, damages, or losses arising from:
Your use of the Platform,
Your violation of these Terms, or
Any third-party rights infringed by your actions.
Munchify may suspend or terminate your Account at any time, with or without notice, if you:
Breach these Terms,
Engage in fraudulent or harmful conduct, or
Misuse the Platform.
Upon termination, you must cease all use of Munchify immediately.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.
Any disputes shall be resolved exclusively by the courts of Nairobi, Kenya.
Munchify may update these Terms from time to time. Updates take effect immediately upon publication on the Platform.
Continued use constitutes acceptance of the revised Terms.
